Do grandparents (and other close relatives) have the right to visit and interact with their grandchildren?
The answer is yes. On many occasions we find family problems between parents and children that cause the clean ones to be deprived of interacting with their grandparents. On other occasions, the problem arises just after the unfortunate death of one of the parents of the minor, and the surviving parent prevents visits or relationships of their child with the grandparents and/or with the family of the parent who has died. This is why the right of grandparents and of the family (tiets and close family) to interact with the minors, thus obliging the parent to facilitate these relationships, which can only be prevented with a just cause. In Catalonia, the provisions of article 236-4.2 of the Civil Code of Catalonia, which establishes the following:2. Children have the right to interact with grandparents, siblings and other close people, and all of these also have the right to interact with their children. Parents have to facilitate these relationships and can only prevent them if there is a just cause. In any case, judges have to ensure that the best interests of the minor are protected.
